Fatal Pedestrian Accidents in California
Pedestrian accidents take the lives of hundreds of people every year in California. Quite often, these accidents are a result of drivers who are reckless and negligent. Although we are required to yield to pedestrians in crosswalks and to provide them with extra care and consideration, we continue to see people lose their lives as a result of accidents caused by careless and negligent drivers who fail to do so. We see countless fatal accidents take place as a result of motorists who are impaired, distracted, or engaging in other negligent actions while operating their vehicles. If your loved one lost their life in a fatal accident, you may be able to file a lawsuit for wrongful death against the driver who is responsible.
In California, only certain people are allowed to file a wrongful death claim. These include the victim’s spouse, domestic partner, child, or parent. If the victim was not married and did not have any children, his or her siblings may be able to file a claim. In order for any of these claimants to be successful, they must be able to prove that the defendant’s negligence contributed to the victim’s death.
There are many different types of damages that can be awarded in a wrongful death claim. These include compensation for:
- Funeral expenses and burial fees.
- Lost earning capacity and loss of benefits.
- Loss of inheritance.
- The loss of services.
- The loss of companionship.
- And more.
Hiring a wrongful death lawyer from Madera to represent you on your claim can provide you with the best chance of getting the maximum amount of compensation possible for these and other damages. Your attorney will be able to investigate your accident, gather evidence, build your case, and aggressively negotiate compensation for your losses.
