After being hurt in an accident, you can pursue a claim for compensation against the driver responsible. In order to prevail, you must be able to prove that the driver owed you a duty of care, breached the duty, caused the accident and that you suffered the consequences.

When it comes to recovering compensation for the damages that you face, California provides compensation to victims based on a comparative negligence doctrine. This means that if you share any fault for the accident, the amount of money you are able to collect is reduced by the percentage of fault that you share.
