In California, damages are provided to victims based on the comparative negligence laws. If a claimant shares any fault for the accident, the amount of fault will reduce the compensation that they are able to recover.
It is critically important that you are able to prove that the defendant was fully at fault for the accident or shares the majority of fault for the accident so that you can maximize your recovery.
