Truck Accidents in California

Visalia, CA – Traffic Collision with Injuries Reported on SR-99 near Betty DrAnyone involved in their first vehicle accident likely has questions about how to go about seeking financial compensation from the at-fault driver. Unfortunately, filing a claim for compensation can be incredibly difficult. An injured party has the burden of proving the other driver’s negligence. There must be evidence of each of the four elements of fault in order to establish liability.

To begin, the injured party’s burden of proof is to establish that the other motorist owed them a duty of care. When behind the wheel, we have a responsibility to drive safely and considerately.

The duty of care requires drivers to always act in a reasonably prudent manner. When determining whether or not a motorist’s actions were reasonable, courts look at what a typical driver would have done, given the same information as the negligent driver. If a typical driver was aware of the potential for injury but continued driving in the same manner anyway, they would be in violation of their duty due to negligent behavior.

A victim of a negligent driver must prove that the victim’s injuries or property damage were caused by the driver’s negligence. To get financial compensation for medical costs, lost earnings, and pain and suffering, an automobile accident victim must prove that the other driver’s negligence directly caused those costs.

It is important that you work with a California truck accident lawyer as soon as possible to provide yourself with the best chance of seeking the maximum compensation for the damages that you face.
