Fatal Pedestrian Accidents in California
Fatal pedestrian crashes take the lives of more than 900 people annually in California. Quite often, these crashes take place as a result of drivers who are negligent. Knowing what to do after losing a loved one in a fatal accident is critical.
In California, families are able to file legal claims against negligent drivers after they lose loved ones due to fatal collisions. There are various parties that are able to file these claims. Entitled parties include the deceased victim’s surviving spouse, children, parents, siblings, or other people who depended on the victim prior to their passing for financial support.
If you are a qualified party, you can file a claim for compensation to alleviate some of the damages that you face after experiencing the unexpected loss. Some of the damages that you can recover include:
- End-of-life costs: after losing a loved one, you can request compensation for funeral expenses, burial expenses, and other end-of-life costs that you face.
- Lost earnings: if your loved one was the breadwinner for the family, you could seek compensation to cover some of the losses that you face from losing their source of income.
- Loss of services: a claimant has the ability to pursue compensation for the loss of services that they experience due to losing their loved one. This can be for household services, such as cleaning or laundry, or other duties that were the responsibility of the defendant prior to their passing.
- Loss of consortium: This damage is available to compensate bereaved family members for the loss of companionship they experience after their loved one dies. This can be a loss of companionship, loss of parental guidance, or loss of affection.
