Anti-Coercian – Definition and Impacts
On January 29, 2016, a Final Rule announced by the U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) back in November 27 of last year went into effect. The Rule grants the FMCSA the authority to penalize motor carriers, shippers, receivers, brokers, and all others who compel truck and bus drivers to violate federal safety organizations.
The FMCSA formulated this Rule in response to multiple reports from drivers who had been pressured with threats of job termination, reduced work or pay, withholding of preferred work hours or jobs, or other forms of retaliation if they did not comply with demands to violate FMCSA regulations, such as Hours of Service (HOS) restrictions, drug and alcohol testing, the transportation of hazardous materials, and other commercial regulations.
These regulations are put in place to ensure the safety of not only truckers but also the motoring public at large. For instance, HOS restrictions prevent fatigued driving, which can be just as dangerous (if not more so) as drunk driving. When companies disregard these rules for the sake of profit, human lives are put at risk. This behavior is unjustifiable, and the FMCSA made the right call by imposing penalties on such perpetrators. Anyone in the supply chain that breaks the Rule will be met with fines of up to $16,000.00.
