If your child was born with birth defects after taking Zofran (ondansetron), you may be entitled to compensation for medical bills, pain and suffering, and other damages. Zofran litigation is growing stronger as more and more affected mothers are coming forward with lawsuits against drugmaker GlaxoSmithKline. The company has already paid out billions of dollars as part of a legal settlement in a federal case, and now they’re returning to court to answer for their wrongful actions in civil cases.

Glaxo Pushed Risky Off-Brand Usage for the Sake of Profit

Zofran was originally approved by the U.S. Food and Drug Administration (FDA) to treat nausea in cancer patients. In an apparent bid to push more of their pills and increase profits, Glaxo later promoted the drug to physicians as a viable treatment option for pregnant women experiencing severe morning sickness. There was just one problem: Zofran was never approved by the FDA for this purpose.

Even worse, multiple research studies have linked Zofran use in pregnant women to increased occurrence rates of various birth defects, including septal heart defects, cleft palate, club foot, and skull deformities. Court documents indicate that Glaxo knew of these risks as early as 1992 yet continued to market the drug to pregnant women without making these risks explicit.

Now innocent infants are paying the price – and for what? More money in the pockets of Glaxo executives? Profit is never, ever worth such great human cost.

Former Zofran Users Are Filing Lawsuits

Lately, multiple Zofran lawsuits have been filed throughout the United States, all of which are based on similar allegations, including the following:

  • Glaxo advertised the drug as safe treatment for nausea in pregnant women although it was never approved by the FDA for this use.
  • Glaxo pushed the drug specifically for treating nausea in pregnant women even though they were aware of the potential risks.
  • Glaxo failed to warn the public about the drug’s link to birth defects.
  • Glaxo deliberately misrepresented the results of their Zofran animal studies, saying the drug was safe when in actuality it exhibited signs of toxicity in the subjects.

Product manufacturers, especially those in the pharmaceutical industry, should never ever place profits ahead of consumer safety. Unfortunately, there are those who feel it is worth devastating human lives to reap huge profits. Such companies should not have their wrongful actions go unpunished.
