Justin F. Marquez is a Senior Partner at Wilshire Law Firm, where he litigates wage and hour class actions, consumer class actions, and false claims cases.
Justin has been instrumental in positively shaping the law to better protect the rights of employees and consumers, having achieved numerous landmark victories on behalf of his clients. Justin briefed, argued, and won Yocupicio v. PAE Group LLC, 795 F.3d 1057 (9th Cir. 2015) (holding that PAGA claims can’t be included in the amount in controversy for determining CAFA jurisdiction even when alleged in a class action complaint), and he wrote the class certification briefs in ABM Industries Overtime Cases, 19 Cal.App.5th 277 (2017) (reversing the denial of class certification for over 40,000 workers for overtime, meal period, split shift, and reimbursement claims). On the consumer class action front, Justin was part of the team of attorneys that prevailed in Moore v. Centrelake Medical Group, Inc., 83 Cal.App.5th 515 (2022) (holding that data breach victims adequately alleged injury in fact under the benefit of the bargain theory and monitoring-costs theory), the $25 million Peters v. Apple false advertising class settlement (2023), and the $14 million Schumacher v. Bank of Hope data breach class settlement (2022).
Justin’s dedication to upholding the rights of employees and consumers against corporate wrongdoers has earned him countless victories. In 2023 alone, he recovered over $75 million in class action settlements.
Justin’s achievements have also earned him the praise and recognition of his peers. In 2024, he received a CLAY Award from the Daily Journal for his work in the Peters v. Apple case. He has been selected as one of the “Best Lawyers in America” since 2023, a “Super Lawyer” since 2022, and a “Super Lawyer Rising Star” from 2017 to 2020, and he holds a 10.0 rating from Avvo.com. A contributing leader in the plaintiff’s bar, Justin is currently a member of CELA’s Wage and Hour Committee and Mentor Committee.
