LOS ANGELES, CA. Feb. 13, 2018 — On Tuesday, February 13, 2018, attorneys Bobby Saadian and Colin Jones of Wilshire Law Firm filed a proposed, nationwide class action lawsuit against Aetna Inc. and its subsidiaries, on behalf of their client Nichol Lundin. If the class action is certified, patients who have been negatively affected by Aetna’s deceptive business practices will also be represented.
The complaint alleges breach of implied contract, violation of California’s unfair competition law, breach of the duty of good faith and fair dealing; unlawful, fraudulent and deceptive business practices.
Aetna breached the contract with its clients, when it denied coverage to patients in need of treatment, on the basis of lack of medical necessity, without a proper assessment by a physician. The company had a duty to provide coverage for treatments related to the terms of the health plan agreement. Instead, Aetna denied claims, contradicting health records and company policies.
Millions of individuals use Aetna as their health insurance provider and didn’t know about the company’s breach of contract. Aetna’s misconduct is fueled by not wanting to pay for much-needed medical treatments. As a result of the company’s improper denials, and lack of physicians reviewing patients’ files and records, customers have suffered damages and losses.
