LOS ANGELES, CA. Dec. 18, 2017 — On Monday, October 9, 2017, Bobby Saadian and Jon Teller of Wilshire Law Firm filed a lawsuit in the superior court, on behalf of their clients (two female minors), against Los Angeles Unified School District (LAUSD).
The complaint alleges that LAUSD acted negligently, when hiring and retaining an employee of the Harry Bridges Span School; LAUSD failed to educate, train, warn and supervise the school’s employee. The complaint also cites sexual battery, intentional infliction of emotional distress, breach of fiduciary duty and negligence, among other theories of liability. LAUSD refused to produce the name of the employee in question, at the time the Wilshire Law Firm personal injury attorneys filed the lawsuit.
The two elementary students, whose identities are protected under government codes, allege that the employee, a nurse at the Harry Bridges Span School, molested them when they went to the nurse’s office to seek treatment. The victims described incidents, in which the male nurse took them into a small room, closed the door and kept them in there for an unreasonable long period of time, touching them inappropriately. The plaintiffs believe that other faculty members at the school and the District knew, or should have known, about the nurse’s inappropriate behavior with the students.
The proposed lawsuit has been filed to put an end to LAUSD’s negligent practices and to raise awareness about incidents of sexual assault. According to the complaint, the school nurse used his position of authority to abuse the minors’ trust; the school and the District had a duty to protect the students from the employee’s inappropriate conduct; but both acted negligently by ignoring the alleged offenses.
