Pedestrian Accidents in California
Pedestrian accidents are often devastating for those involved. Every year, these accidents take the lives of hundreds of people while leaving thousands more injured here in California. If you are unfortunate enough to be harmed as a result of the pedestrian accident, it is important that you understand your legal rights and the options that you have.
Following a pedestrian accident, you are able to seek financial compensation from the person who caused you harm. You will need to prove that an act of negligence led to the accident taking place. In California, there are four elements of negligence that must be proven when it comes to succeeding in filing a personal injury claim.
First, you must prove that the driver, also known as the defendant, owed you a duty of care. In general, any person who operates a vehicle in the state of California is required to be mindful of other people sharing the road. Next, you must prove that the driver breached the duty of care. This could be done by showing that the driver failed to yield the right-of-way, that they were speeding, or even impaired while operating their vehicle.
You must then demonstrate that the breach of duty was the cause of your crash. For example, if you were crossing in a designated crossing area and the driver of the vehicle proceeded through without stopping, they can be held liable in most cases. After demonstrating that the breach caused the accident, you must prove the damages that you have suffered. This could be anything from medical expenses to lost wages or more. Working with a Los Angeles pedestrian accident lawyer will provide you with the best chance of proving your case and getting justice after an accident.
