The Futon Shop Lawsuit Investigation: A Latex Pillow and a Wool Futon Mattress

What The Futon Shop Investigation Is About

A California furniture maker's discounted listings

The Futon Shop says it has been “inspired by nature since 1976,” and its website describes furniture handcrafted in California, from futons and sofas to organic mattresses and bedding. It sells through its own stores as well as online.

Wilshire Law Firm is investigating allegations that The Futon Shop advertised fake sale prices on two products, its Organic Latex Body Pillow and its Eco Pure Wool Futon Mattress, by comparing its prices with reference prices that may not have been genuine. These are allegations only: no court has made any determination, and the matter remains an investigation.

What the Two Product Pages Showed on October 6

Discounts of 50% and 45% off listed reference prices

When we checked on October 6, 2026, the Organic Latex Body Pillow carried a “Special Price” of $134.98 next to a crossed-out $269.95, with the label “Save 50%.” The Eco Pure Wool Futon Mattress, a made-to-order mattress with a 2-inch natural Dunlop latex core between layers of virgin wool, showed “From: $769.98” beside a crossed-out $1,399.96 and “Save 45%.” The homepage that day advertised a “Fall Into Comfort Sale” of up to 50% off mattresses and futons.

The FTC’s Guides Against Deceptive Pricing frame the question simply: “Where the former price is genuine, the bargain being advertised is a true one.” When the former price is fictitious, the guides say, the advertised bargain is a false one. The investigation is examining which of those describes these two listings, and nothing has been established.

Do You Qualify for The Futon Shop Investigation?

In-store and online buyers since January 1, 2026

The investigation is currently open to buyers who meet each of these points:

  • You are a California resident.
  • You purchased an Organic Latex Body Pillow or an Eco Pure Wool Futon Mattress from The Futon Shop, either in person or online.
  • Your purchase was made between January 1, 2026 and the present.

Store purchases and online orders are both covered by these criteria. Because eligibility is assessed one purchase at a time and the criteria can change, a free consultation is the way to confirm where you stand.

Records to Keep From The Futon Shop

Receipts from a store visit or an online order

  • An in-store receipt or an online order confirmation showing the product, date and price.
  • A card or bank statement with the charge.
  • Screenshots of the “Special Price” or “Save” labels, if you captured them.
  • Mailers, emails or ads for a sale you shopped during.

Have only one of these? That’s enough to start. This information is general and not legal advice.

Why the Size of a Discount Matters

How a 45% or 50% label can shape a decision

A large percentage-off label can be what tips a shopper toward buying, especially on a mattress listed in the four figures before the discount. If the higher price was not one the item regularly sold for, the savings may be smaller than they appeared. A legal professional can line up your receipt with what the investigation learns about these products’ pricing and explain any options.

FAQs

It concerns allegations that The Futon Shop advertised fake sale prices on its Organic Latex Body Pillow and Eco Pure Wool Futon Mattress, comparing its prices with reference prices that may not have been genuine. No court has made any finding.

The pillow showed a $134.98 “Special Price” against a crossed-out $269.95, labeled 50% off, and the mattress showed “From: $769.98” against $1,399.96, labeled 45% off.

It can be, if the higher price is genuine. California’s Business and Professions Code section 17501 ties former-price claims to the prevailing market price in the prior three months, and federal guides look for a price that was really offered. Whether these listings met those standards depends on the facts.
