Options After the Otay Lakes Road Crash

What happens when the driver at fault has died

A preliminary police account is not a final finding of fault. If investigators conclude that a driver who died caused a crash, the people that driver hurt can still bring a claim. California lets them pursue an insurance-covered claim against the deceased driver’s estate without naming an estate representative as a party, and recovery in that kind of case generally comes from the driver’s liability insurance (Probate Code §§550, 554). If you are dealing with a crash of your own, our page on the steps to take after a car accident in California can help.

Deadlines also change when the person responsible dies. A claim against someone who has died generally must be filed within one year of the death (Code of Civil Procedure §366.2), though an insurance-covered claim against the estate can follow a different timeline (Probate Code §551). Because these rules interact, it can help to have the dates reviewed early.

This is not legal advice, only a general summary of California law. The details of your crash, and the insurance involved, decide which rules apply.

Generally, yes. California allows an insurance-covered claim against the deceased driver’s estate, with any recovery in that kind of case generally coming from the driver’s liability insurance (Probate Code §§550, 554). Deadlines are different when the person responsible has died (Code of Civil Procedure §366.2; Probate Code §551).

If you carry underinsured motorist coverage and the at-fault driver’s liability limits are lower than your own uninsured motorist limits, that coverage may apply once the at-fault driver’s liability coverage has been paid out (Insurance Code §11580.2).
